How does ClearSale handle data disposal?

ClearSale may use a client’s data for as long as reasonably necessary. The client may request that their data go through an anonymization or pseudonymization process.

By either encrypting, removing, or replacing personally identifiable information from its data, the people whom the data describe remain unidentifiable.

ClearSale will destroy or return to the client their data within 90 days upon request, and in each case, in accordance with applicable laws. 

All media containing data are stored securely while not in use and destroyed or disposed of when no longer needed for business purposes. Electronic storage media containing data are rendered unrecoverable by secure wiping, degaussing, or physical destruction, such as grinding or shredding hard disks, so that data cannot be reconstructed.

All hard-copy materials containing data are destroyed by shredding, incineration, or pulping processes so that data cannot be reconstructed.

The client’s data may be retained: 

  • Pursuant to applicable data retention laws, provided that the client’s data are not accessible in the ordinary course of business.
  • If the client’s retained data constitute electronic records kept for the purposes of backup, recovery, contingency planning, or business continuity planning (any such purpose, a recovery purpose) and are otherwise not accessible in the ordinary course of business. 

We are not entitled to access the client’s data for recovery purposes. If any of the client’s data retained for recovery purposes are restored or otherwise made accessible, we agree that it must immediately and permanently delete the records.
